MARLOWE MEDIA TERMS OF SERVICE:

By scheduling services with Marlowe Media, the client agrees to the following Terms of Service.

TURNAROUND TIMES:

Standard photo delivery is completed within two (2) business days following the scheduled on-site appointment unless otherwise stated in writing. Business days exclude weekends and holidays.
Video production, aerial media, virtual tours, floor plans, and advanced editing services may require additional processing time.

CANCELLATIONS & RESCHEDULING:

Appointments canceled or rescheduled with less than twenty-four (24) hours’ notice are subject to a $50 non-refundable cancellation fee.
Same-day cancellations or reschedules, including situations where the property is not ready, accessible, occupied, unsafe, or otherwise unsuitable for photography or filming, will incur the same fee.
If Marlowe Media arrives on-site and is unable to complete services due to property condition, access issues, safety concerns, weather, or client-related delays, the appointment may be canceled or rescheduled at Marlowe Media’s discretion and additional fees may apply.

WEATHER POLICY:

Marlowe Media is not responsible for delays, limitations, or cancellations caused by weather or other conditions outside of its control.
Drone/aerial services cannot be performed during rain, snow, lightning, excessive wind, temporary flight restrictions, poor visibility, or other unsafe or restricted flying conditions.
Outdoor photography quality may also be affected by weather, seasonal conditions, smoke, haze, neighboring construction, parked vehicles, or other environmental factors beyond Marlowe Media’s control.
If weather conditions prevent completion of services, affected portions of the appointment will be rescheduled for the next mutually available date. If rescheduling cannot reasonably be accommodated, Marlowe Media will refund only the portion of the invoice related to the affected services.

TRAVEL FEES:

A travel fee of $2.00 per mile applies to appointments located outside the standard service area.
The standard service area includes locations within a twenty-five (25) mile radius of Marlowe Media’s primary office. Mileage is calculated based on round-trip travel.
Additional travel surcharges may apply for extended travel times, remote locations, ferries, parking fees, tolls, or special access requirements.

PAYMENT TERMS:

Payment is due upon receipt of invoice and/or media delivery unless otherwise agreed to in writing.
Final edited media may be withheld until payment is received in full.
Invoices not paid within seven (7) calendar days may be subject to late fees or suspension of licensing rights.
Returned payments, chargebacks, or disputed transactions may result in immediate revocation of all usage rights until the account is resolved.

COPYRIGHT & LICENSING:

Marlowe Media retains all copyrights and ownership rights to all photographs, videos, drone footage, floor plans, virtual tours, and related media created during the appointment.
Upon full payment, the client is granted a limited, non-exclusive, non-transferable license to use the delivered media solely for the marketing and promotion of the specific property listing for which the media was originally created.
This license automatically expires once:
The property is sold, Leased, Withdrawn from the market, Transferred to another agent, team, brokerage, or owner, Or otherwise no longer actively represented by the client.
Media may not be:
Sold,
Transferred,
Shared with third parties,
Given to builders, stagers, designers, contractors, Airbnb operators, or other vendors,
Reused for future listings,
Used in advertising unrelated to the original property listing,
Altered beyond standard cropping or resizing,
Or edited using filters, AI tools, or additional processing
without prior written permission from Marlowe Media.
Any unauthorized use constitutes copyright infringement and may result in additional licensing fees or legal action.

PORTFOLIO & PROMOTIONAL USE:

Marlowe Media reserves the right to use any created media for portfolio display, website content, social media, advertising, competitions, educational purposes, and promotional materials unless otherwise agreed to in writing prior to the appointment.

DRONE COMPLIANCE:

All drone operations are conducted in accordance with applicable FAA regulations and airspace restrictions.
Marlowe Media reserves the right to refuse or cancel drone services if flight conditions are unsafe, restricted, or unlawful.
No guarantee is made that aerial services can be completed at every property location.

LIMITATION OF LIABILITY:

Marlowe Media’s liability for any claim, loss, or damages arising from services provided shall be limited to the total amount paid by the client for the affected services.
Marlowe Media shall not be liable for indirect, incidental, consequential, or special damages, including but not limited to lost profits, lost listings, marketing delays, or missed business opportunities.

CLIENT RESPONSIBILITY:

The client is responsible for obtaining all necessary permissions from homeowners, tenants, occupants, HOAs, property managers, builders, or other parties prior to the appointment.
The client assumes full responsibility for ensuring the property is legally authorized for photography, videography, and drone operations.

FORCE MAJEURE:

Marlowe Media shall not be held liable for delays or failure to perform caused by circumstances beyond reasonable control, including but not limited to weather, natural disasters, government restrictions, power outages, equipment failure, illness, emergencies, labor shortages, transportation issues, or acts of God.

ACCEPTANCE OF TERMS:

Scheduling services with Marlowe Media constitutes acceptance of these Terms of Service in full.
